23. It has also been observed by the Hon'ble Supreme Court in the
decision reported in AIR 2003 Supreme Court 1369 in the case of Uday
Vs. State of Karnataka in para 16 with reference to a Division Bench
decision of Calcutta High Court in the case of Jayanti Rani Panda Vs. State
of West Bengal and Another reported in 1984 Cri.L.J. 1535 (Cal) at 1538 in

by this Court in State of H.P. v. Mange Ram (2000) 7 SCC 224,
BalaKrishnan, J. speaking for the Court observed :-
