celebrated judgment of Hon'ble Supreme Court in Parle Products (P) Ltd.
Vs. J.P. and Co., [(1972) 1 SCC 618. The principle has been articulated by
Hon'ble Supreme Court in paragraph 9 of the said judgment, which is of
relevance. Paragraph No.9 of aforesaid Parle judgment reads as follows :
