2.13 The appellant is lawfully entitled to seek any material used against him
by the 10, with further liberty to examine, or cross-examine any material witness
in the course of the Inquiry proceedings. 3- Without prejudice to these humble
submissions, it is also placed on record that the Hon'ble Supreme Court in para. 22
of the recent judgment dated 23-11-2022 in the case of UOI and Ors. v Subrata
Nath in SLP (C) no. 7939-7940 of 2022, have categorically held that the
Disciplinary Authority and the Appellate Authority are vested with the exclusive
powers to examine the evidence forming part of the inquiry report in the following
categorical terms-
Section 7 in The Right to Information Act, 2005 [Entire Act]
Section 18 in The Right to Information Act, 2005 [Entire Act]
