In Osman Fakir Mahomed Divecha v. Ali Akbar Javed Sadakya & another, , it was held that where a lease of open land situated in the Bombay Suburban District was made for constructing "buildings of every description howsoever" from time to time, the purpose for which the land was demised clearly was for constructing buildings of any description and not for constructing buildings for residence, education, business, trade or storage. It was, therefore, held that the land demised, though "premises" within the meaning of section 5(8), was not "premises within the meaning of section 6(1) of the Rent Act.
