In Roop Singh Negi Vs. Punjab
National Bank & Ors., (2009) 2 SCC 570 , the
Supreme Court has held that an enquiry officer and a
disciplinary authority in a departmental proceeding
perform a quasi-judicial function, who have a duty to
arrive at finding upon consideration of materials on
record. The evidence collected during investigation by
the investigating officer cannot be treated as an
evidence before the disciplinary authority without proof
of such document.
