Tahsildar And 3 Others vs State Of U.P. And Another on 19 March, 2021
36) The Hon'ble Supreme Court in Criminal Appeal No.67
of 1958 in Tahsildar Singh and others vs. State of Uttar
Pradesh1 elaborately dealt with the issue. So, having regard to
the above, now this Court has to see as to whether the evidence
of P.Ws.1 to 3 is convincing and whether the contention of the
appellant that P.Ws.2 and 3 were not the direct witnesses is
tenable. It is to be noticed that when the case of the appellant
is such that according to Ex.P.1, accused allegedly intimated to
P.Ws.2 and 3 that he stabbed the deceased, there is no cross
examination of P.W.1 inviting his attention to the contents of
Ex.P.1, which was his previous report in writing.
