Vijaysinh Chandubha Jadeja vs State Of Gujarat on 29 October, 2010
44. It is relevant to note that in Arif Khan (supra), the Supreme Court
had referred to the decision of the Constitution Bench in Vijaysinh
Chandubha Jadeja (supra) and observed that the search and recovery
of the contraband made from the appellant in that case, did not satisfy
the mandatory requirements of Section 50 of the NDPS Act, as
enunciated by the Supreme Court in Vijaysinh Chanduba Jadeja
(supra). It is, thus, apparent that the Court did not accept the
prosecution's case that the provisions of Section 50 of the NDPS Act
were complied with.
