He has
urged that ordinarily the court may not interfere with the
second show cause notice and the petitioner is aware of the
decision of the Supreme Court rendered in case of Union of
India & Anr versus Kunisetty Satyanarayan reported in
MANU/SC/5137/2006. However, this is the case where the
departmental proceedings are once again initiated after three
years at the time when the petitioner had moved an
application for voluntarily retirement. On mere pre-meditated
conducive show cause notice is issued and therefore this
deserves consideration.
