I am of the view that the ratio decided by the division bench in both
the cases are conflicting and runs counter to each other. To eradicate the
conflicting judgments to operate in the field, I am of the view that the
matter should be placed before the Hon'ble Chief Justice for constituting
the larger bench to answer which of the ratio laid down in case of Biswajit
Das and ors. and Tanmoy Chowdhury and ors. are the correct
proposition of law.
