In this context also the observations of the single Bench judgment of this Court in Nagarjuna Finance Ltd. v. Kanosika Laboratories Ltd [1998] 94 Comp. Cas. 127 ought to be noted wherein the learned single judge observed that the words 'other legal proceedings' will not embrace proceedings like those under Section 138 of the Negotiable Instruments Act. The learned single Judge went on to observe that thee criminal proceedings, particularly like Section 138 of the Act, have no bearing whatsoever on the purposes for which this section has been enacted.
