24. In the alternative, Sri L. Ravichander, the learned senior counsel contends that the government before allotting the lands, should have conducted a price discovery exercised by offering the lands on public auction and thereby maximize returns to the State. He would submit that the fixation of an arbitrary price by the government is incorrect and is not in the interest of the State. As contended by the learned Advocate General, the Hon'ble Supreme Court in the cases of Kasturi Lal Lakshmi Reddy & Ors. vs. State of J & K1, A.P. Dalit Mahasabha vs. Government of Andhra Pradesh & Ors.,2 A.P. Dalit Mahasabha vs. Government of Andhra Pradesh & Ors.,3 and Natural Resources Allocations, In Re.,4 had held that the State has the discretion to decide the best process of allocation or alienation of land or any natural resources and the method of auction cannot be the only process where maximization of revenue is not the main purpose and where land or such natural resources are sought be allotted for ensuring industrial development. These judgments are binding on this court and accordingly, this contention of the petitioners would have to be rejected.
