State Of Himachal Pradesh & Ors vs Shri Dharam Das on 25 August, 1995
20. Further in a case law reported as State of Himachal Pradesh v/s
Dharam Dass, 1992(1) C.L.R, it has been ruled that the prosecution has to
prove the guilt against beyond all reasonable doubt and that too by leading
independent, reliable and unimpeachable evidence. There is no controversy
to the proposition that the accused is entitled to the benefit of every doubt
occurring in the prosecution case.
