23. The Tribunal considered the judgments of the High court of
Andhra Pradesh at Hyderabad in B.Kanakaratnabai case, and also the
judgment of the Hon‟ble Apex Court in Kulsum case, and held that
1st respondent is not liable to pay compensation, and 2nd respondent
being owner of the bus is liable to pay compensation, but erred in holding
that insurance company is not liable to indemnify the 2nd respondent the
insured in the case.
