14. It appears that the the decision in M. Ramjayarams case has been wrongly applied in Annexure A-10. That case was dealing with awarding of additional marks for seniority in the selection for promoting the candidates as Law Assistant. In that case the contesting respondents have been assigned 15 marks for their seniority, and therefore, the appellant could not get selected and hence he challenged the awarding of 15 marks as discriminatory and violation of the Constitution. The Apex Court while considering the fact that the contesting respondents are not from the same unit but of different units, held that the weightage of 15 marks given to them is illegal. Thus, what has been held by the Apex Court in M. Ramjayarams case is that when candidates are from different streams and from separate seniority lists, it is illegal to take into account the seniority of a candidate assigned to him in a different unit while he takes part in a selection where candidates from other streams are also eligible to contest. However, the draftsman of Annexure A-10 has enlarged the scope of Apex Courts decision in M. Ramjayaram (supra) by stating that;
