13. This Court feels fully supplemented with the authoritative
judgement of the Hon'ble Supreme Court of India cited as "State
of Andhra Pradesh vs. Md. Hussain @ Saleem" clubbed with

Agency" AIR (SC) Cri 2255, decided on 13-09-2013, also relied
upon by the learned counsel for the respondents. The relevant

6. He submitted that a statutory remedy available to the petitioner in
terms of Section 439 of the Code cannot be denied to him on the
pretext of the Provisions of Section 21 of the NIA Act, which
Provisions do not at all bar the filing of a subsequent petition
under Section 439 of the Code. The learned counsel in support of
his arguments placed reliance on the judgements cited as
"Gudikantt Narasimhulu vs. Public Prosecutor, High Court of
A.P."
