As already observed hereinabove, 1st defendant herein has been successful in preventing the plaintiffs from enjoying the fruits of decrees obtained by her from the competent Civil Courts by not only filing suit after suit but also obtaining interim orders by using trick and stratagem and as such it has to be examined as to whether appellants are required to be mulcted with cost in the present appeal. The fact that cost should follow the cause is the normal course and the Hon'ble Supreme Court in the case of Ila Vipin Pandya Vs. Smita Ambalal Patel reported in 2007 (6) SCC 750 has held as under:
