9. Shri P.K. Paul, learned counsel appearing for the respondents (OPs)
has argued that when respondents (OPs) received intimation from the
appellant (complainant) regarding the incident of fire, they appointed
Kiran Chhabra as Surveyor, who assessed the loss the tune of
Rs.12,80,835/-. The complainant received a sum of Rs.12,79,698/- from
the respondents (OPs) in full and final satisfaction of his claim, therefore,
the appellant (complainant) is not entitled to get any more amount from
the respondents (OPs). The appellant (complainant) relinquished his
remaining claim, therefore, he is not entitled to get any more amount
under his claim from the respondents (OPs). Shri P.K. Paul, learned
counsel for the O.P. has argued that it appears that the case of the
appellant (complainant) comes within under insurance. The appeal is
liable to be dismissed. He placed reliance on Sikka Papers Limited Vs.
National Insurance Company Limited & Others, 2010 NCJ 9 (SC) and
National Insurance Company Limited Vs. Nipha Exports Private Limited
2007 (1) CPR 80 (SC).
