14. Considering the above, it is pertinent to
note that, in the instant case, the Court under
Section 34 had indulged in an exercise of
evaluation of the award on its merit and
proceeded to determine the market value of the
land in question on reappreciation of evidence as
well as admission of new evidence like a Court of
appeal under Order XLI of the Code of Civil
Procedure. Such an exercise was impermissible
within the scope of modification which has now
been permitted to a limited extent by the Apex
Court in its recent decision dated 30.04.2025 in
Gayatri Balasamy (supra).
