The Supreme Court whilst approving the principle in Sayed Jaleel Zane vs. P. Venkata Murlidhar - AIR 1981 AP 328 has held that the court always leans against a perpetual renewal and hence where there is a clause for renewal subject to the same terms and conditions, it would be construed as giving a right to renewal for the same period as the period of original lease, but not a right to second or third renewal and so on unless, of course, the language is clear and unambiguous. 21] In the facts of the present case, in the lease Deed dated 25th September 1953, there was neither any clear clause for renewal nor is it is the case of lessee that any option for renewal was exercised in terms of Lease Deed dated 25 th September 1953.
