In the present case, the appellant had placed an advance with the respondent for supply of goods, it does not matter who is the supplier or the receiver of goods and services as laid down in the M/s Consolidated Construction Consortium Ltd. The present case is squarely covered by the above discussed Judgment, as there is a clear nexus between Company Appeal (AT) (Insolvency) No. 1234 of 2023 -15- payment made and supply of goods and services. Accordingly, we decide that the appellant is to be treated as Operational Creditor in the instant case.
