Ajitprasad Ramkishan Singh vs The State Of Maharashtra on 2 May, 1972

In support of his contention, Mr. Debnath, learned PP i/c relies upon the case of Ramkishan v. State of Maharashtra . Mr. Debnath, finally submits that the learned trial Court very rightly released the other two accused persons on probation as they were not directly involved with the culpable homicide not amounting to murder of the deceased. The brickbat thrown by them was only to injure the deceased but no such acts of those accused caused death to the deceased, and not only that both accused were woman and children respectively, therefore, the acts of those accused cannot be compared with the act of the present appellant so far penal offence is concerned and for the aforesaid reasons the appeal is liable to be dismissed. However, so far the reduction of sentence is concerned Mr. Debnath left the matter to the Court. Mr. Debnath, also mainly relies and referred to the evidence of P.W. Nos. 1, 3, 4, 5, 6 and 11.
