The counsel also referred paragraph 14 of the judgment in the case of BHUPENDRA RAMDHAN PAWAR referred supra wherein also GURCHARAN SINGH's case was referred stating that it is settled law that the 55 Collector or the court who determines the compensation for the land as well as fruit-bearing trees cannot determine them separately. The counsel also brought to notice of this Court the judgment in the case of AMARJIT SINGH referred supra wherein discussion was made with regard to Section 23 of the Land Acquisition Act and in paragraph 14, it is held that the learned counsel for the respondents submitted that as this Court has treated additional amount under Section 23(1-A) as part of the market value, additional amount payable under Section 23(1-A) of the 1894 Act is neither interest nor solatium.
