cautioned the Courts regarding the difference between civil and
criminal wrongs. There can be a situation, where the allegations may
contain both civil and criminal grounds. Court must cautiously
examine the facts to ascertain whether they only constitute a civil
wrong or if the ingredients of the criminal wrong are missing and
thereby, quashed the order passed by the Magistrate.

The Hon'ble Apex Court in the matter of
Deepak Gaba and Another Vs. State of Uttar Pradesh and Another
(supra) has held that in number of cases the parties are invoking
jurisdiction of Criminal Courts by filing the criminal complaint
though allegations are purely civil in nature. Therefore, the law laid
down by the Hon'ble Apex Court in the above referred judgments,
are squarely applicable to the present case.
