Kunwar Singh's case (supra), it was held that in the light of above
statutory provision, non cognizable offence cannot be investigated by
the police without an order passed by the Magistrate. It was held
that, there is nothing in the section which dis entitle the complainant
to approach the court with a prayer to direct the police to conduct
investigation.
