(xiv) It is humbly submitted that, the submission of petitioner is
related to the insolvency proceedings because before the
insolvency employer has already defaulted in the payment of
statutory dues on scheduled time and accordingly offence
already committed and subsequently registered. Therefore, ratio
of Ashok Kumar Vs. New India Assurance Co. Ltd.9 is not
related to this case.
