Therefore, it is clear that the decision of the
Division Bench of this Court in Laxman Tulsiram v.
Dayalal Meghji and Co (Supra) is not only contrary
to the trend of judicial decisions on the point in
question but it also goes contrary to the decisions of
the Supreme Court in cases mentioned above.
