23. As back as in 1936 the Privy Council has observed
in the case of Bhojraj vs Sita Ram and others [AIR 1936

60] that the real tests for either
accepting or rejecting evidence are how consistent the
story is with itself, how it stands the test of
cross-examination and how far it fits in with the rest
of the evidence and the circumstances of the case. If
we apply these tests in the present case, in our opinion
the ocular evidence of so called eye witnesses cannot be
accepted and conviction cannot be based on their
evidence.
