35. I would take up the case of Ram Kumar appellant in the first instance. Indeed only a lalkara is attributed to this appellant. My learned brother has observed that right from the earliest times the Courts have looked upon the evidence relating to a lalkara with extreme disfavour. He has extracted the observations of the Supreme Court in Amar Singh v. State of Haryana and Jainul Haque v. State of Bihar . To my mind, however, these observations could be of no benefit to the case of Ram Kumar appellant. The circumstances which lead me to this conclusion are these. Ram Kumar was the real brother of Chander Sheikhar deceased. It is the prosecution case that there was a family dispute in regard to the land of Surji Devi widow of Bhagat Ram, a third brother who had since died. The three brothers, namely, Chander Sheikhar deceased, Gautam and Parshotam had given some land to the said lady in a family settlement and Ram Kumar appellant had challenged this arrangement by means of a suit.
