The decision in S.P. Chengalvaraya Naidu (supra) has been
relied upon in connection with the allegation of fraud. This Court does not,
prima facie, find that the award was induced by fraud and corruption. In
this case, the arbitral Tribunal dismissed the petitioner's application for
production of the statement of claim filed by the respondent against BPBCC,
in the other proceeding, with reasons. This is not a case of non-disclosure of
material evidence before the learned Tribunal.
