The trial Court considering the facts and circumstances of the case giving rise to the incident, the manner in which the incident occurred, the fact that there is no evidence to ascertain as to which of the accused caused which injury by which weapon to the complainant, there was free fight between the parties, keeping in view the decision of the Hon'ble Supreme Court in Balkar Singh Vs. State, AIR 1994 SC 1133, recorded a finding that the prosecution has failed to prove its case against the accused beyond all reasonable doubt and therefore, acquitted them of the charge under Section 325/34 of IPC.
