paragraph No.73 (C) it has been held that- "The court
will have to satisfy themselves on the compliance

(ix) Since investigation has already been
completed and charge sheet has been laid before the
court, there is no scope of hampering investigation or
tampering the witnesses. Now trial will start and the

accused has to prepare his defence. And as such his
further custodial detention seems to be not warranted,
as held by Hon'ble Supreme Court in the case of Sanjay
Chand (Supra).
