In the case of Raja Ram v. State of Rajasthan, (2005) 5 SCC 272, the
Supreme Court has observed that prosecution witness who did not support
the prosecution case and not declared hostile with the permission of the
court, his evidence would be binding on the prosecution. Therefore, the
evidence of PWs 5, 6 and 7, who did not support the prosecution story,
would be binding on the prosecution."
