Court in Suraj Lamp Industries Vs. State of Haryana, 11.10.2011
and Anathula Sudhakar Vs. P. Buchi Reddy, dated 25.03.2008 , it
will be important to state that the documents on which appellant is
placing reliance, are the similar to/connected to the documents on
which the respondent relies. Both have similar origin/titles if
documents are perused and are also unregistered. So no one can
claim better title and there can be no cloud upon the title when the
title is not in issue in this case and the only issue is regarding the
possession. It is submitted that there can be no injunction against
the true owner cannot be accepted as there is no certainty regarding
the ownership in this case. Moreover, there is no document with the
respondents and are stated to have been lost whereas there is
complete chain of documents in favor of the appellants.
