Sanjay Thakur vs The State (Govt. Of N.C.T. Of Delhi) ... on 10 September, 2007
(71) The 'Last Seen' theory comes into play where the time gap
between the point of time when the accused and the deceased was last
seen alive and the deceased is found dead is so small that possibility of
any person other than the accused being the author of the crime becomes
impossible. It is a settled law that even in such cases the courts should
look for such corroboration. (Sanjay Vs. State of U.T. Chandigarh
Criminal Appeal No. 1699/2005 decided by the Hon'ble Supreme Court
on India on 5.5.2006).
