3. Learned counsel for the petitioners made the
submission that learned Magistrate passed the order
without taking into consideration whether the
requirements of the judgment of the PRIYANKA
SRIVASTAVA AND ANOTHER VS. STATE OF UP AND
OTHERS reported in AIR 2015 SC 1758 case are
complied with or not. It is also his submission that
while referring the matter to the police, there is no
application of mind by the learned Magistrate and it is
only a mechanical order passed by the learned

Magistrate referring the matter to the police and report.
Even on the merits also, he made the submission that
the complainant has not made out the case on the
alleged offences. It is the abuse of process of the Court.
On these grounds learned counsel for the petitioners
sought to allow the petition and to quash the
proceedings.
