Surendra Kumar Asthana vs Smt. Kamlesh Asthana on 31 August, 1973
In the case of Surendra Kumar Asthana v. Smt. Kamlesh Asthana, AIR 1974 Allahabad 110, the Court concluded that a revision application under Section 151 of the Civil Procedure Code between the parties who were parties to the matrimonial proceedings, is also a proceeding under the Act. The expression "in any proceeding under this Act" has been stated to be an expression of wide meaning. Connotation given to the expression was stated to include all proceedings arising out of or in any manner linked with the main petition. An application by die husband for setting aside an ex-parte order passed under Section 24 of the Act, granting maintenance to the wife, was held to be a proceeding linked with the main petition. Consequently, the application for interim maintenance in that proceeding was held to be maintainable.
