In the case of Girdhar
Shankar Tawade vs State Of Maharashtra reported in 2002 ALL
MR (Criminal) 1669, the Hon'ble Apex Court has explained the
purpose and meaning of cruelty as defined in Section 498 of the

IPC. The basic purport of the statutory provisions is to avoid
'cruelty' which stands defined by attributing a specific statutory
meaning attached thereto as noticed herein before. Two specific
instances have been taken note of in order to describe a
meaning to the word 'cruelty' as is expressed by the legislatures :

24. This aspect is also considered by the Hon'ble Apex
Court in the judgment of Preeti Gupta & Anr vs State Of
Jharkhand & Anr reported in (2010) 7 SCC 667 when the
Hon'ble Apex Court observed in paragraph Nos. 30, 32 and 34
observed that
"30. It is a matter of common experience that most
of these complaints under Section 498-A IPC are filed in the heat
of the moment over trivial issues without proper deliberations.
We come across a large number of such complaints which are
not even bona fide and are filed with oblique motive. At the
same time, rapid increase in the number of genuine cases of
dowry harassment are also a matter of serious concern.
