20. In the present case, first type of criminal trespass only is
required to be considered. For commiting trespass, it is sufficient
if a person enters into or upon any property, which is in
Criminal Revision No. 183/2020 Kirti Kumar v. Vipin Kumar and others 13
possession of another with intent to commit an offence or
intimidate, insult or annoy any person in possession of such
property. The person in whose property trespass is committed,
must be in possession of said property. There is no
requirement/ingredients of criminal trespass that the person who
is in possession of the property, must be owner also of the said
property. It is sufficient if said person is in possession of said
property.
