5. Under Section 428(1), Criminal P. C. in dealing with any appeal under this Chapter, the appellate Court, if it thinks additional evidence to be necessary, shall record its reasons and may either take such evidence itself, or direct it to be taken by a Magistrate, or, when the appellate Court is a High Court, by a Court of Sessions or a Magistrate. The revisional Court has been vested with powers to take additional evidence under Section 439 (1), Criminal P, C. (See Ramakantha Khadigar v. State ). It is, therefore, open to me to accept the valid route permit as a piece of additional evidence.
