16. The learned counsel for the respondents has cited the judgment of
the Hon'ble Apex Court in Union of India and Others Vs. M.K. Sarkar
[(2010) 2 SCC 59], on the question of delay and laches in filing the OA.
The reply statement of the 3rd and 4th respondents submits that the cause
of action arose as far back as on 11.2.2010 and 7.7.2010 when the
absorption was ordered. The applicant failed to approach the Tribunal at
that time.
