the second view of the brothers of the deceased or some other person
being the author of crime being equally possible, the view pointing
towards the innocence of the accused has to be adopted.
(113) This being the background, I hereby hold that the
prosecution has not been able to prove and establish beyond reasonable
doubt the allegations against the accused Harvinder Singh and Sunil @
Sethi of having committed the murder of Shiv Kumar and hence
benefit of doubt is being to both the accused who are acquitted of the
charges under Section 302/34 Indian Penal Code.
