In view of the legal position settled in
paras 22-24 of the judgment of the Apex Court in
Alcon Electronics' case (supra), Ext.P-4 Divorce
decree/order of the Superior Court of Justice,
Ontario will amount to a "Decree" of a Superior
Court of a reciprocating country as understood in
Explanation II of Sec.44A CPC and hence is
executable. So also, in view of the legal position
settled in Paras 14 and 19 of that Apex Court
judgment, Ext.P-4 order/decree of that foreign
court of the reciprocating country, will not fall
within the exceptions of Sec.13 CPC.
