25. It is settled that mere allegation of fraud will not suffice for
restraining the petitioner from encashment of a bank guarantee. The
party alleging fraud shall have to prima-facie establish fraud as a triable
issue adducing strong evidence. The Hon‟ble Supreme Court in Ansal
Engineering Projects Ltd. v. Tehri Hydro Development Corpn. Ltd.,
(1996) 5 SCC 450 has held as under:-

to irretrievable injury and injustice to stay encashment a bank guarantee.
