The lower appellate Court agreed with the trial Court that the sons had failed to prove the immoral character of their father though he had shamelessly endeavoured to support his sons case by swearing to his own immorality. It held that the burden of proof had been rightly laid on the sons to prove the immorality or unlawfulness of the origin of the debt; and referred to Gajadhar v. Jadubir A.I.R. 1925 All.
