Referring the same, Learned P.P. drawn the attention of the Court
that the observation of Learned Special Judge that no contraband item was
found from the possession of the respondent-accused is also contrary to the
principle of law laid down by the Hon‟ble Apex Court because the Learned
Special Judge without considering the other materials on record and the
statements of witnesses so far collected by the IO during investigation,
released the accused on interim bail which was totally illegal and unwarranted.
