23. It has been well established in catena of judgments particularly
in the age old case of R Vs Prince wherein the defendant was
convicted under a statute making it unlawful to take any unmarried
girl under the age of 16 years out of the possession and without the
consent of her parents. Although the girl taken by defendant was 14
years old, she had told the defendant and the defendant reasonably
believed that the girl was 18 years and it was held that where a statute
is silent as to the mens rea required to make the act a crime, the Court
is not bound to need a requirement of mens rea into the statute.
