For the view we have taken on points No. (i) and (ii), we refrain ourselves from finally opining on this point though prima facie we are of the opinion that in view of the judgment of the Apex Court in State of Sikkim v. Dorjee Tsfter-ing Bhatia and others, JT 1991(3) SC 456 : 1992(1) SCT 80 (SC) in the absence of Disqualifications having been laid down by the Rules or by executive instructions, the 1990 Rules cease to be workable. However, as observed above, we are not finally opining on this point.
