The learned counsel for the respondents, on the other hand, stated that the first order issued by the Directorate of Health Services dated 1.06.2011 was reviewed by the Fast Track Committee of the Government and it was decided after taking into account all the relevant factors to restrict the 2nd 4 OA No.2083/2015 and 3rd financial upgradation under MACPS to the Grade Pay of Rs.4600 and 4800 only. Relying on Union of India Vs. S.R.Dhingra (2008 (2) SCC 229) and Chandi Prasad Uniyal Vs. State of Uttarkhand (2012)(8) SCC 417), the learned counsel submitted that once the pay of the applicant has been correctly fixed at a lower level, the respondents were responsible for recovery of the amount received by the applicant in excess of the salary/pension.
