In A.B.C. Laminart Pvt. Ltd. v. A.P. Agencies (AIR 1989 SC 1239) (supra), the Supreme Court while considering the clause in the agreement which provided "Any dispute arising out of this sale shall be subject to Kaira jurisdiction" held that this was not a clause which would mean exclusion of jurisdiction of other Courts where it has jurisdiction to entertain the matter as the cause of action or part thereof has accrued within the jurisdiction of that Court. The Supreme Court held that such ouster of Jurisdiction of Civil Court should not and ought not be Inferred from an ambiguous provision,
