Learned counsel for the appellant relied upon the judgment of Hon'ble Supreme Court in case of Anathula Sudhakar vs. P.Buchi Reddy (Dead) By L.Rs & Ors. reported in 2008 AIR SCW 2692 and in case of Akkamma and Ors Vs Hemavathi reported in 2021 (10) SCC 1187, where the plaintiff was able to show that he is in possession and that he is entitled for relief of injunction. The DW1 has admitted in 40 the cross examination that the property of the defendant situated on the southern side of the road and this admission clearly goes to show that the properties are two portions of the same survey number. The said admission of the defendant No.6 clearly reveals the plaintiff schedule property is situated on the northern side.
